Terms of Service

These Terms of Service (the “Terms”) govern your use of the Audov mobile applications (iOS and Android), web app, websites, and related services (collectively, the “Service”). “Audov”, “we”, “our”, or “us” refers to Audov. Contact: support@audov.net.

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Who May Use the Service

• You must be at least 13 years old (or the minimum age required by your country) to use the Service. If you are under the age of majority, you must have your parent/guardian’s permission.
• You may not use the Service if you have been previously removed or banned by Audov.
• You confirm you can enter a binding agreement and will comply with all applicable laws.

3) Accounts & Sign‑In

You may sign in using social login providers (e.g., Apple and Google). You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. Notify us immediately of any unauthorized use.

4) The Audov Platform

Audov hosts content uploaded by multiple independent creators via our web app (“Creator Content”). We do not routinely pre‑screen all content, but we may review, remove, or restrict content or accounts at any time for any reason, including to enforce these Terms, comply with law, or protect our users and partners.

5) User‑Generated Content & License

When you submit, post, or otherwise make available any content (including comments, replies, likes, follows, tips, reviews, profile information) on Audov (“UGC”), you grant Audov a worldwide, non‑exclusive, transferable, sublicensable, royalty‑free license to host, store, cache, reproduce, publish, display, perform, adapt, modify (formatting only), and distribute your UGC for the purpose of operating, promoting, and improving the Service.

You represent and warrant that you own or have the necessary rights to your UGC, and that your UGC does not infringe, misappropriate, or violate any third‑party rights or laws.

6) Community Guidelines

To keep Audov safe and welcoming, you agree that you will not post, share, or engage in:

• Illegal, infringing, or deceptive content or conduct.
• Hate speech, threats, harassment, doxxing, or explicit sexual content involving minors.
• Spam, scams, or attempts to manipulate engagement (fake likes/follows/comments).
• Malware, phishing, or content that interferes with normal operation.

We may remove violating content and take enforcement actions, including warnings, suspensions, or termination.

7) Creator Terms (for publishers on the web app)

• You must own or have rights to all content you upload, including text, audio, images, and metadata.
• You are responsible for the accuracy of descriptions, proper categorization, and compliance with laws (e.g., copyright, privacy, consumer protection).
• You grant Audov the necessary licenses to host, transcode, stream, and deliver your works to end users, and to use your brand assets to promote your content on the Service.
• We may implement editorial standards and technical requirements; failure to meet them may delay or prevent publication.

Audov may offer in‑app virtual tokens and tipping features to support creators. Tokens are a limited, non‑transferable, revocable license right to use virtual items for designated features within the Service; they have no cash value, and cannot be exchanged for real currency or redeemed outside the Service.

• Purchases are final: Except where required by law or platform policy, token purchases are non‑refundable and non‑reversible.
• We may modify, manage, control, or eliminate tokens at our discretion, and we will not be liable for exercising these rights.
• Tips sent to creators are voluntary and may be subject to platform fees and taxes.

Audov offers auto‑renewing subscription plans via Apple App Store (iOS) and Google Play (Android). The subscription title, length, and price are displayed in‑app before purchase.

• Billing: Payment is charged to your Apple ID or Google account at confirmation of purchase.
• Auto‑renew: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
• Renewal charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Manage or cancel: You can manage and cancel subscriptions in your device account settings: iOS Settings → [Your Name] → Subscriptions; Google Play → Profile → Payments & subscriptions.
• Free trials: If offered, any unused portion of a free trial is forfeited when you purchase a subscription. After a free trial ends, the subscription automatically converts to a paid plan unless canceled.
• Refunds: Refunds are handled by Apple or Google per their policies. Learn more at Apple’s Manage Subscriptions and Report a Problem, and Google’s Subscriptions and Refunds.

Platform note: Purchases made on iOS and Android are processed by Apple and Google respectively, and Audov does not store your full payment information.

10) Advertising

The Service may display advertising (e.g., via Google AdMob). Ads help keep some features available at low or no cost. You may see ads tailored to your device or preferences in accordance with our Privacy Policy and your device settings.

11) Notifications

We use Firebase (or similar services) to deliver push notifications about updates, new content, and relevant offers. You can control notifications in your device settings and in‑app preferences.

12) Third‑Party Services

Audov integrates with third‑party services such as Apple, Google, Firebase, AdMob, analytics providers, and payment processors. Your use of such services may be subject to their terms and privacy policies in addition to ours.

13) Intellectual Property; Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on Audov infringes your copyrights, please send a notice with the information required by 17 U.S.C. §512 (or applicable law) to copyright@audov.example. We may remove or disable access to material alleged to be infringing and may terminate repeat infringers.

14) Prohibited Uses

• Accessing or using the Service for any illegal or unauthorized purpose.
• Infringing others’ rights, including IP, privacy, or publicity rights.
• Circumventing security, scraping, or reverse engineering the Service.
• Using bots or automated systems to create accounts or manipulate metrics.
• Uploading viruses, malicious code, or interfering with the Service.

15) Suspension & Termination

We may suspend or terminate your access at any time for any reason, including violations of these Terms or risk to the Service or other users. You may stop using the Service at any time. Some provisions survive termination (e.g., licenses granted by you, disclaimers, limitations of liability).

16) Disclaimers

The Service and all content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation.

17) Limitation of Liability

To the fullest extent permitted by law, Audov and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any conduct or content of any user or third party; or (c) unauthorized access, use, or alteration of your transmissions or content.

In no event shall our aggregate liability exceed the greater of (i) the amounts you paid to us for the Service in the 12 months preceding the claim, or (ii) USD $100.

18) Indemnification

You agree to defend, indemnify, and hold harmless Audov and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service, your UGC, or your violation of these Terms.

20) Changes to the Service or Terms

We may modify the Service and these Terms. If we make material changes, we will provide notice (e.g., in‑app or via email). Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes become effective constitutes acceptance.
